Kentucky Cannabis Laws in 2026

Short answer

In 2026, recreational cannabis is still illegal in Kentucky. Kentucky has a medical cannabis program for registered patients, but outside that program, possession, sale, and cultivation can still bring criminal charges.

Recreational cannabis

Illegal. There is no legal recreational possession allowance in Kentucky, even for adults 21 and older, and there is no state-level decriminalization. Home cultivation is also illegal, including for registered medical patients.

Medical cannabis

Legal for registered patients. Kentucky legalized medical cannabis through Senate Bill 47, signed March 31, 2023, with the program taking effect January 1, 2025. Registered patients with a qualifying condition and a state card can buy from licensed dispensaries. Smoking and home cultivation rules are set by the program — check the official Kentucky Office of Medical Cannabis rules before assuming a form or method is allowed.

Possession penalties outside the medical program

Possession of less than 8 ounces is a misdemeanor, punishable by up to 45 days in jail and a fine of up to $250. Possession of 8 ounces or more can be treated as trafficking, with much harsher penalties. Cultivating fewer than 5 plants is a first-offense misdemeanor punishable by up to 1 year in jail; cultivating 5 or more plants can be a felony punishable by up to 5 years.

Arrests and enforcement

Kentucky made 2,718 cannabis arrests in 2025, with 80.1 percent for possession alone, according to the Marijuana Policy Project 2026 Cannabis Arrest Report using FBI Crime Explorer data. Kentucky Center for Economic Policy research found 303,264 Kentuckians were charged with cannabis offenses from July 2002 to June 2022, with roughly 59 percent convicted, and conviction rates varying widely by county.

What KCFC wants voters to decide

KCFC is pushing for a constitutional amendment, mirroring HB225, that would let voters decide whether adults 21 and older can possess up to one ounce of cannabis and cultivate, harvest, and store up to five plants for personal use, free of criminal sanction. The General Assembly would regulate production, processing, and sale. Kentucky is a non-ballot-initiative state, so only the General Assembly can refer the amendment to voters.

Frequently Asked Questions

Is weed legal in Kentucky?

Not for recreational use. Medical cannabis is legal only for registered patients in the state program.

Can I grow cannabis at home in Kentucky?

No, home cultivation is illegal, including for medical patients, under current law.

What happens if HB225 passes?

If approved by the General Assembly and voters, it would establish the 21-plus, 1-ounce, up-to-5-plants protections described above, with the General Assembly regulating production, processing, and sale.
